Our submission argues that the proposed section would undermine the Government’s Nature Positive Plan reforms, which promise significant improvements to Traditional Owner consultation and environmental decision-making processes. Following the landmark Tipakalippa Federal Court decision that highlighted inadequate consultation with Traditional Owners in offshore petroleum approvals, we believe any future regulatory changes should be subject to scrutiny under the reformed EPBC Act, rather than being locked into the current 2014 approval framework that predates these important legal and policy developments.
