Our submission argues that the $58.5 billion decommissioning program must incorporate free, prior and informed consent principles and statutory recognition of Traditional Owner Representative Institutions. We recommend amendments to include FPIC considerations in both mandatory removal categories and permitted sea dumping assessments, implementation of Indigenous Procurement Policy provisions with mandatory set-asides for affected TORIs, and shared government-proponent funding to resource Traditional Owner participation in decision-making processes affecting their sea country rights and cultural heritage.
