It recommends that any declaration be made subject to a condition under s 20 of the Offshore Electricity Infrastructure Act, requiring that no licence be granted within the declared area without the consent of affected Traditional Owners. The Sea Country Alliance argues that omitting this condition would be a reviewable error and that its inclusion aligns with Australia’s international obligations, stated policy, and legislative objectives.
